Order

Suspension of plastic waste recycling plants

 

  • Pursuant to the Industry processing no. 048/NA, dated 27th December 2013.
  • Pursuant to the organization and implementations of the Ministry of Industry and Commerce no. 230/PM, dated 24th July 2017.

 

            To enable the management, improvement and adjustment of manufacturing plants that use plastic waste as material, as part of efforts to improve standards in the processing industry, reduce the impact on social and environmental and comply with the government’s policy on economic and social development in a green and sustainable direction.

 

Minister of Ministry of Industry and Commerce issues an order as follows:

  1. To temporally freeze the issuing of business operation licenses to these manufacturing plants that use plastic waste as materials until it has the new order or decree to replace this order.
  2. The enterprises/plants that have already received permission such as business certificate, investment license or business and infrastructure permits to carry out this type of business, it may continue to operate as normal based on industry processing. After obtaining an industry license that be able to operate a product.
  3. The enterprises/plants that have already received permission such as business certificate, investment license or business permits but not yet obtained infrastructure permit. It has to stop immediately until has the new order or decree to replace this order.
  4. Processing plant that uses waste plastic as raw materials which obtained Factory Certificate and processed those plants agreed to continue processing but given to the Provincial, Capital of Industry and Commerce to coordinate with relevant agencies collecting data and monitoring. In case the plants miss technical standards based on relevant laws and regulations such as location, technique and production technology, raw materials warehouse, building factory, safety, health safety and environmental safety that must suspense on processing and withdraw factory certificates. After completed the improvement on a technical standard that can be requested for renewing factory certificate to obtain factory permit and continue for production processing.                              
  5. The ongoing illegal processing plants without permission based on relevant laws and regulations such as one permit for example enterprise certificate, investment or activities license, infrastructure permit, factory certificate those must stop immediately and take action on the measures in accordance with enterprise law and regulations strictly.
  6. The Department of Industry and Commerce at the provinces, capital, District Office of Industry and Commerce shall guide the line agencies and businesses within their province, capital for acknowledgment and collaboration on the implement this notification effectively.
  7. The Department of Industry and Handicraft, Department of Industry and Commerce at the provinces, capital, District Office of Industry and Commerce to strictly implemented.
  8. This order is effective from the date it is signed and published in official gazette fifteen days.
